Terms of Service

1. The service

TIR40 is a web application for road hauliers: a weekly planning board for trucks, trailers, drivers and loads; a no-login link for drivers; document storage; invoicing and reports; and optional AI features. We may improve, change or remove features. We will not make a change that seriously harms your use of the service without reasonable notice.

2. Closed pilot and access codes

TIR40 is currently offered as a closed pilot. Creating a company needs an access code we have given you. During the pilot the service is provided free of charge, for the trial period and up to the number of active trucks shown in the app, and without any promised level of availability. We may end the pilot or change its limits by telling you in advance.

3. Accounts

• Your company's administrator decides who may use the account and with what role (administrator, manager or dispatcher), and is responsible for what those people do in it.
• Keep sign-in details secret and tell us promptly if you think an account has been compromised.
• Give accurate company details and keep them up to date.

4. Fees

The pilot is free. If we later charge for TIR40, the price and billing terms will be shown to you or agreed in writing before they apply, and nothing is charged without your agreement. Prices exclude VAT unless stated otherwise.

5. Your data

• The data you put into TIR40 remains yours. You give us the right to host, process, back up and display it as needed to provide the service.
• You are responsible for having a lawful basis to enter personal data about your drivers, employees and customers' contacts, and for telling drivers what is recorded about them — in particular the position captured when a driver taps “Arrived” or shares their location.
• Our Data Processing Agreement forms part of these terms and governs how we handle that personal data for you.
• You can export your company's data from Settings at any time. If you close the account we delete the data as set out in the DPA.

6. AI features

Some features use a third-party AI service — reading an uploaded transport-order PDF or a pasted order email into a load, reading a photographed signed CMR, and drafting some emails. The result can be wrong or incomplete. You must check it before you rely on it; TIR40 asks you to confirm extracted loads before they are saved, shows what it read from a CMR only as a hint next to the photo (the photo itself is always the record), and never sends an email on its own. A photographed CMR is read automatically when it is uploaded. Content you send to an AI feature is passed to the AI provider named in our Privacy Policy. Do not upload documents you are not allowed to share with a service provider.

7. Planning aids are not legal or regulatory advice

The driving-time and weekly-rest indications, compliance reminders (expiry dates), per-diem calculator, invoice helpers and reports are aids. They are not a tachograph, not a substitute for the rules that apply to you (for example Regulation (EC) No 561/2006 and the Mobility Package), and not accounting or tax advice. You remain responsible for complying with the law and for checking figures before you rely on them or issue invoices.

8. Acceptable use

Do not: break the law using TIR40; try to access another company's data or to bypass limits or security; upload malware or content that infringes others' rights; overload the service; resell or share your account outside your company; or use the service to build a competing product.

9. Availability and support

We work to keep TIR40 available but do not guarantee it will be uninterrupted or error-free, especially during the pilot. We may take it down briefly for maintenance. Support is by email at contact email on a reasonable-efforts basis.

10. Third-party services and integrations

If you connect a third-party service (for example an invoicing service such as SmartBill, Oblio or FGO, or a fuel-card provider's report) you do so under your own account and credentials with that provider. Their terms apply, and we are not responsible for their services.

11. Intellectual property

TIR40, its software, design and name belong to us or our licensors. You get a limited, non-exclusive, non-transferable right to use it for your business while your account is active. We do not claim ownership of your data.

12. Warranty and liability

To the extent the law allows, TIR40 is provided “as is”, without warranties of any kind beyond those that cannot be excluded. We are not liable for indirect or consequential loss, or for loss of profit, revenue, contracts or goodwill. Our total liability for anything arising from the service is limited to the fees you paid us in the 12 months before the event, or EUR 100 if you have paid nothing (for example during the free pilot). Nothing in these terms limits liability that cannot be limited by law, such as for intent, gross negligence, or death or personal injury.

13. Suspension and ending

You may stop using TIR40 and ask us to close your account at any time. We may suspend or close an account for a serious or repeated breach of these terms, for non-payment once fees apply, or if the law requires, telling you why unless we are not allowed to. After closing, data is handled as set out in the DPA.

14. Changes to these terms

We may update these terms. For a material change we will give at least 30 days' notice in the app or by email; if you do not agree, you may close your account before it takes effect. Continued use afterwards means you accept the new terms.

15. Governing law

These terms are governed by Romanian law. The courts of the competent courts of Bucharest have jurisdiction, without affecting any mandatory rights you may have.
